Restriction on Users of Hazardous Equipment
The employer must restrict to authorised persons the use of any work equipment that is likely to involve a specific risk to health or safety.
Before authorising any employees and entrusting them with the task of using such equipment, the employer must, under regulation 13 of the Management of Health and Safety at Work Regulations 1999:
- take into account their capabilities as regards health and safety;
- ensure they are provided with adequate health and safety training.
The employer is advised to take similar precautions as regards any non-employees whom he wishes to authorise as a user.
Depending on the nature and severity of the risks associated with use of the equipment, the employer may need to prohibit the authorisation of young persons and/or new and expectant mothers.
