Employers must be aware of their duties when considering employing workers from overseas. Not only is it important to follow the correct procedures and checks to ensure that an overseas worker is legally entitled to work in the UK, but businesses must also avoid discriminating against prospective employees on the basis of their nationality or ethnic origin.
All offers of employment must be subject to the candidate providing the employer with the required original documents demonstrating the right to work in the UK, or the employer being able to carry out a check on the Home Office online right to work checking service: https://www.gov.uk/employee-immigration-employment-status .
If it is established that the prospective employee or employee does not have the right to work in the UK, employment may be terminated.
