This Post Coronavirus lockdown: Return to work – pregnant employee letter should be used to arrange a meeting with a pregnant employee to discuss their safe return to the workplace.

With effect from 19 July, the government is no longer instructing individuals to work from home if they can. This puts employers in a stronger position to require their employees to return to the workplace, provided they have implemented proper safety measures before requiring employees to return.

All workplaces should follow the “COVID-19 Secure” guidelines, the aim of which is to ensure the risk of infection is as low as possible, while allowing as many people as possible to resume their livelihoods: https://www.gov.uk/guidance/working-safely-during-covid-19.

This letter explains the special safety measures that the employer has put in place to protect employees. Employers have a duty to protect the health and safety of their employees and must follow the government guidance relating to their business sector. Employers must also carry out a risk assessment of the risks in their own workplace and take the necessary steps to address those risks before recalling employees to the workplace. Example risk assessments can be found in the COVID-19 Back to Work documents. 

In addition to these safe working arrangements, the employer must also consider the risks to pregnant employees/workers on an individual basis and consult them about potential adaptations to their role or working arrangements. These adaptations may include allowing the employee to continue working from home or transferring them to an alternative role.
