Agency Terms and Conditions for Lease Renewal (Landlord)
These Agency Terms and Conditions for Lease Renewal (Landlord) can be used by commercial property agencies when handling lease renewals and lease terminations under the Landlord and Tenant Act 1954 for commercial landlords. These terms and conditions, when used with the Agency Appointment Form for Lease Renewal (Landlord), create a contract between the agency and the landlord.
The terms and conditions include a clause relating to the Minimum Energy Efficiency Standards (MEES) which came into force on 1 April 2018.
Clause 1 contains definitions and in some cases refers to information contained in the Appointment Form.
Clause 2 covers the appointment of the agent.
Clause 3 sets out the duties of the agent. These include providing advice and conducting negotiations.
Clause 4 sets out the duties of the landlord. These include paying an agency fee to the agent. Details of fees are set out in the appointment form.
Clause 5 deals with termination of the contract between the agent and the landlord.
Clause 6 makes reference to the agent’s complaints handling procedure.
Clauses 7-11 are standard clauses dealing with legal interpretation, notices, VAT, the relationship of the parties and jurisdiction.
