Commercial Landlord’s Approval of Property Particulars Form
This Commercial Landlord’s Approval of Property Particulars Form is designed for use by Commercial Lettings Agents who need to seek the Landlord’s approval of draft commercial property particulars. The Landlord should be asked to review and approve the draft particulars before marketing of the property commences.
The Agent should send two copies of this Form, and two copies of the draft particulars, to the Landlord. The Landlord will keep one set for their records and return the other to the Agent with approval or amendments.
Commercial Lettings Agents have duties under the Business Protection from Misleading Marketing Regulations 2008 (BPRs) not to make any incorrect or misleading statements about the properties they are marketing, and not to omit any relevant information.
In order to comply with the BPRs, Commercial Letting Agents should make sure that they are in possession of all relevant information about the commercial property they are about to market.
Use of this form – which asks the Landlord to check the draft particulars and either approve or amend them – will prompt the Landlord to consider whether they have given the Agent all the necessary information.
The form includes a declaration that the person signing the form is authorised to do so. This is designed to ensure that the form is signed by a suitably senior person within the Landlord organisation. The Agent should keep the signed form on file.
