Touring Caravan Licence Agreement
This Touring Caravan Licence Agreement should be used by the Owner of a caravan site who wishes to allow a guest to bring a caravan onto the Site. The Agreement is designed to be printed out and signed by both parties. The Agreement sets out the main details at the beginning, being the parties’ names, the Site, the pitch number, the licence period and the pitch fee. The different elements of the pitch fee can be listed, e.g. payments for additional occupiers and vehicles, extra charges for gazebos, awnings, electricity and drainage etc.
Clause 1 is the grant of the licence. As well as the right to use the pitch, the guest is given the right to use shared parts of the Site and communal facilities. Optional wording can be included if there is an additional charge for use of the facilities.
Clause 2 contains standard legal interpretation clauses.
Clause 3 covers payment of a deposit (which is a percentage of the pitch fee) and the balance of the pitch fee.
Clause 4 deals with cancellation. If a booking is cancelled with plenty of notice all sums, including the deposit, are to be refunded. If the booking is cancelled at short notice the Owner will retain the deposit. If the guest is a “no show” the booking is deemed to be cancelled and the Owner will retain the deposit.
Clause 5 contains the guest’s covenants. These cover how the tent is to be pitched, careful use of the pitch and the Site and other practical matters. There are three versions of the “pets” clause: no pets; one well behaved dog; and pets allowed only with the express consent of the owner. There is an optional restriction on the forming of “groups” on the Site.
Clause 6 is the termination clause. This allows the Owner to terminate the licence if there has been a substantial breach of any of the guest’s obligation or if the guest’s behaviour is unacceptable to the Owner.
Clause 7 is a limitation of liability clause.
Clause 8 is a jurisdiction clause.
Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so as to be compatible with one another. Unused options should be removed from the document.
