This Car Parking Licence for Multiple Days can be used by the Owner of a Driveway or a private Parking Space who allows motorists to park a car there on a regular basis, for payment of a licence fee. The Licence specifies a Licence Period (which could be anything from a few days to many months) and also sets out the Permitted Days and Permitted Hours when the Parking Space may be used.
This document is suitable for Owners of driveways or parking spaces near railway stations, airports or sports stadiums where there is heavy demand for affordable parking. Clause 1 contains the definitions. A plan can be attached to show the location of the Parking Space if it cannot be adequately described in words.
Clause 2 contains the grant of the Licence. The Licence is personal to the Licensee.
Clause 3 covers payment of the Licence Fee. One option is for the Licence Fee to be paid in full when the Licence is entered into. However, unless the Licence Period is very short, this is unlikely to be practical. The alternative clauses provide for the first week’s (or month’s) Licence Fee to be paid up front and for weekly (or monthly) payments thereafter.
Clause 4 deals with cancellation. The Licence agreement can be cancelled by the Licensee at any stage before the Licence Period starts but the Licensor will retain a specified amount of money depending on when notice of cancellation is received. This ranges from an administration fee (e.g. £10) for early cancellations to 100% of the first week’s (or month’s) Licence Fee for a last minute cancellation. Termination is also possible by either party during the Licence Period by giving a specified period of notice, e.g. 1 month. The Licensor may also terminate the Licence if the Licensee does not pay the Licence Fee or is in breach of the Licence.
Clause 5 contains the Licensee’s covenants. These relate to the proper use of the Parking Space.
Clause 6 sets out the Licensee’s rights in the event that the Licensee does not vacate the Parking Space outside the Permitted Hours (an overstay).
Clause 7 contains some standard clauses including a requirement for notices (e.g. a notice to terminate the Licence) to be served in accordance with section 196 of the Law of Property Act 1925. This means that notices should be delivered by hand or sent by recorded or special delivery post. If the notice is sent by recorded or special delivery post, service is deemed to occur at the time at which the letter would “in the ordinary course” be delivered.
