We have provided a number of Agreements for use by professionals. There are two versions of each type of Agreement, to cover the situation where either:
- as a self-employed sole trader, the individual personally contracts with the salon (in this subfolder); or
- he does not personally contract with the salon but instead provides his freelance services through a personal service company. It contracts with the salon as an intermediary company (in the accompanying Hair & Beauty Chair Rental Agreements (Company) subfolder).
Each personal contract version seeks to minimise the risk that HMRC will regard the individual as an employee of the salon rather than as a self-employed sole trader. Each personal service company version seeks to minimise the risk that IR35, agency worker, employment law, or other legislation will have an adverse impact on the individual and/or his/her personal service company.
As explained in the information page accompanying each form of contract, use of these (or any other) particular forms of contract can only seek to reduce but cannot actually remove these risks. Professional advice should therefore be sought, and that advice needs to take account not only of the content of the proposed document but also all of the circumstances and arrangements relating to the work, the individual, any personal service company, and the salon.
