Intellectual Property rights – new cease and desist letters

For many businesses, particularly those in creative and inventive industries, the protection of intellectual property rights is vital to the business’ success.

Intellectual property rights comprise:

• Copyright – which applies to written and recorded work (e.g. music, drawings, photographs, software)
• Trademarks – signs, words and logos that distinguish a product
• Patents – which protect inventions
• Registered Designs – to protect the appearance of a product.

The infringement of intellectual property rights is acknowledged to be an increasing problem for businesses. Owners of IP rights need to take care to protect their rights and be prepared to take action if their rights are infringed.

This month we have launched a set of documents to help businesses deal with intellectual property disputes. The folder contains “cease and desist” letters for a number of scenarios. Sending a cease and desist letter can be a useful first step when a business needs to take action in relation to an infringement of its intellectual property rights.

The cease and desist letters cover infringements of copyright, trademarks, patents and registered designs. There are also letters dealing with breaches of confidence and breaches of the terms of a licence.
