Alternative Work Offer Letter
In cases where the employee is subject to disciplinary or management interviews and hearings concerning work performance / lack of qualifications / prolonged sickness absence / frequent sickness absences this Alternative Work Offer letter is part of the process whereby the employer seeks to find an employment a position more suitable to the employees present circumstances.
In respect of redundancy an employer should consider whether alternative employment for the employee in question exists within his organisation.
If before the end of employment under the previous contract as a result of redundancy, you offer the employee a comparable job or one which is suitable alternative employment, and the offer takes effect immediately on the termination of the previous contractor unreasonable refusal by the employee to take the alternative job can prevent a claim for statutory redundancy pay.
The employee taking such an alternative position on different terms (wholly or partially) to the original contract is entitled to a statutory trial period of four weeks. If, before or during the trial period, you or the employee wish the experiment to end, the employee will be taken as having been dismissed as from the date his original job terminated.
