Rent Increase Notice Template (Section 13 Form 4)

This Section 13 Landlord's Notice proposing a new rent under an Assured Periodic Tenancy of premises situated in England be used where a residential landlord wishes to increase the rent paid by a periodic assured (or assured shorthold) tenant. This Notice is only suitable for properties in England.

The Notice complies with section 13(2) of the Housing Act 1988, as amended by the Regulatory Reform (Assured Periodic Tenancies) (Rent Increases) Order 2003.

When Should This Notice Be Used

A Section 13 Notice can only be used for Assured Periodic Tenancies, or Assured Shorthold Tenancies in cases where a Rent Review Clause is not already included in the Tenancy Agreement, or the fixed term has ended. Landlords can only use this process to increase the rent once every 52 weeks. It cannot be used during the first 52 weeks of a Contractual Periodic Tenancy. 

The Notice contains detailed notes for landlords and tenants, including guidance on the notice period the landlord must give before charging the new rent. If a tenant wishes to dispute the increase it can refer the Notice to a Tribunal which will determine the open market rent.

Changes to Rent Increases Under Upcoming Legislation 

When the Renters Rights Bill comes into effect, periodic tenancies will replace all fixed term tenancies, and landlords will only be able to use a Section 13 Notice to increase rent. Any rent review clauses or alternative mechanisms in tenancy agreements will no longer be valid. 

Currently, landlords must give at least one month’s notice of a rent increase using a section 13 Notice, Under the Renters Rights Bill, this period will increase two months.

The proposed legislation also gives tenants strengthened rights to challenge unfair rent increases. The First Tier Tribunal will no longer be able to increase the rent above the landlord’s proposed amount, nor can it backdate any rent increase. In cases of genuine financial hardship, the Tribunal will have the power to defer a rent increase for up to two months.
