This Notice of Underletting of Whole of Premises can be used to inform the Landlord that an Underlease has been granted of the whole of the tenant’s premises.
If the Underlease is of part only of the tenant’s premises the Notice – Underlease of Part should be used instead.
There is usually a covenant in the Lease requiring a Tenant to advise the Landlord when an underlease has been completed. This should be done as soon as possible after completion of the underlease. Usually a fee is payable to the Landlord for registering a Notice of Underletting. A cheque should be sent with the Notice.
It is good practice to send the Notice in duplicate so that the Landlord can sign and return one copy as evidence that the Notice has been received.
