Tenant Fees Act 2019 (England) 
The Tenant Fees Act 2019 (“The Act”), has been in effect since 2019 and applies exclusively to England. The purpose of the Act is to minimise the “hidden” costs that tenants face in residential tenancies.
The Act sets out fees which landlords and lettings are permitted to charge, and fees which are prohibited. A breach of the Act will result in a financial penalty of up to £5,000 for the first offence. If a further offence is made within five years of the first, it can constitute a criminal offence and the landlord or letting agent can face an unlimited fine and a “banning order”.
