Possession Proceedings
The temporary court procedures for possession were due to end on the 30 July 2021 but have now been extended to the 30 November 2021.
In short, temporary, non-statutory arrangements were introduced towards the end of last year to assist courts on how to reopen, what cases shall be prioritised and how possession claims made before 30 August 2020 could be reactivated. The Government have strongly encouraged parties to find alternative means of resolving disputes for example, agreeing a rent payment plan, or using a mediation service.
If a claim for possession is still made, until the 30 November 2021 you must provide a statement setting out how the tenant has been affected by the coronavirus pandemic and further information on the tenant’s financial position. If this is not provided the court may not progress your case. More information on this matter can be found here.
The guidance notes on possession proceedings using both the accelerated and standard procedure have been updated, to reflect these new arrangements.
