Particular General Duties to Manage H&S

In addition to his main general duties, the employer is guided by particular general duties in the Health and Safety at Work Act as regards plant, systems of work, articles, substances, information, instruction, training, supervision, place of work, access, egress and working environment. The employer must:

1. provide plant that is, so far as is reasonably practicable, safe and without risks to health as regards his employees;
2. maintain such plant so that it remains, so far as is reasonably practicable, safe and without risks to health as regards his employees;
3. provide systems of work that are, so far as is reasonably practicable, safe and without risks to health as regards his employees;
4. maintain such systems of work so that they remain, so far as is reasonably practicable, safe and without risks to health as regards his employees;
5. have arrangements for ensuring, so far as is reasonably practicable, safety and the absence of risks to health in connection with the use, handling, storage and transport of articles;
6. have arrangements for ensuring, so far as is reasonably practicable, safety and the absence of risks to health in connection with the use, handling, storage and transport of substances;
7. provide such information as may be necessary to employees or to any other person as is necessary to ensure, so far as is reasonably practicable, the health and safety at work of his employees;
8. provide such instruction as may be necessary to employees or to any other person as is necessary to ensure, so far as is reasonably practicable, the health and safety at work of his employees;
9. provide such training as may be necessary to employees or to any other person as is necessary to ensure, so far as is reasonably practicable, the health and safety at work of his employees;
10. provide such supervision as may be necessary to employees or to any other person as is necessary to ensure, so far as is reasonably practicable, the health and safety at work of his employees;
11. maintain, so far as is reasonably practicable, any place of work under the employer's control in a condition that is safe and without risks to health as regards his employees;
12. provide, so far as is reasonably practicable, means of access to and egress from any place of work under the employer's control that are safe and without risks to health as regards his employees;
13. maintain, so far as is reasonably practicable, means of access to and egress from any place of work under the employer's control so that they remain safe and without risks to health as regards his employees;
14. provide a working environment for his employees that is, so far as is reasonably practicable, safe and without risks to health;
15. provide a working environment for his employees that is, so far as is reasonably practicable, adequate as regards facilities and arrangements for their welfare at work.

The employer has other particular general duties in the Health and Safety at Work Act where he makes non-domestic premises available for people not in his employment to use those premises as:

- a place of work (for example, office or workshop space rented out to tenants); or
- a place for using plant or substances provided there for their use (for example, a self-service launderette).

In such circumstances, the employer who has or shares responsibilities as a controller of those premises must take reasonable measures to ensure, so far as is reasonably practicable, the absence of risks to health or safety to non-employees visiting the premises as regards:

- the premises themselves;
- the means of access and egress;
- any plant or substance in the premises.
