Residential Possession Claims

Due to the pandemic, temporary measures were introduced to assist courts in dealing with possession claims. Further information can be found in the January newsletter Terminating Residential Tenancies.

Many of these measures, including the ‘Pre-Action Plan,’ Covid-19 case marking and the introduction of a short review appointment have now ended.

Landlords have had to provide a statement setting out how the tenant has been affected by the coronavirus pandemic when submitting their possession claim. This requirement was due to end on 30 July this year, then extended to the 30 November 2021 and has been further extended to the 30 June 2022.

The guidance notes on proceedings using both the accelerated and standard procedure have been updated to reflect these changes.
