Employers who employ EEA or Swiss citizens who were resident in the UK by 31 December 2020 should encourage eligible individuals to apply to the EU Settlement Scheme: https://www.gov.uk/settled-status-eu-citizens-families/eligibility. Irish citizens who want to continue living in the UK do not need to apply to the EU Settlement Scheme.

The deadline for applications to the EU Settlement Scheme is 30 June 2021.

Individuals who apply to the EU Settlement Scheme, successfully, will be able to continue living and working in the UK after 30 June 2021.

Individuals will be given either:

· settled status - if they have lived in the UK for a continuous 5-year period; or

· pre-settled status - if they have not lived in the UK for 5 years in a row.

There is no legal obligation for employers to advise employees to apply to the EU Settlement Scheme and, similarly, there is no requirement for the individual to inform their employer if they have applied or of the outcome of their application.
