When should our charity use this procurement agreement rather than the supplier's own terms?
Whenever the service matters enough that failure would hurt: consultancy, IT support, maintenance, event management or bookkeeping. Supplier standard terms limit the supplier's liability and lock you in; a charity-side agreement defines deliverables, ties payment to them, preserves termination rights and protects your data and name. Why is this agreement limited to non-fundraising services?
Because paying someone to fundraise is regulated differently: professional fundraisers must work under agreements meeting the Charities Act 1992 prescribed requirements, with solicitation statements to donors, and an ordinary services agreement does not satisfy that regime. If any part of the service involves soliciting funds for your charity, use the professional fundraiser agreements in the Charity Fundraising and Finance group instead.
