Workplace Regulations Coverage

The Workplace (Health, Safety & Welfare) Regulations 1992 (Workplace Regulations) cover every workplace with a few limited exceptions.

Examples of work sites covered by the Workplace Regulations are:

traditional workplaces such as offices, shops, hotels, pubs, restaurants, schools, colleges, hospitals, clinics, railway stations, airports, factories, warehouses, etc.;

unusual workplaces where non-operational means of transport are used as a work site, such as a stationary railway carriage used as a restaurant, a decommissioned warship used as a tourist attraction, etc.;

Certain types of work sites are excluded from the Workplace Regulations, whilst some other kinds of work sites are covered only in special ways:

Operational ships, boats and hovercraft;

Mines, quarries, offshore oil or gas extraction platforms and other mineral extraction sites, including any workplace on the same site;

Construction sites and site offices;

Fenced off construction sites within a workplace (such as during building repairs or alterations, or other forms of modification, extension or conversion) which are instead covered by Construction Regulations for the duration of works.

Those work sites covered in special ways include:

Aircraft, trains and road vehicles which are covered by the rules on falls and falling objects (see B 3.4, Falls and Falling Objects) when stationary in a workplace other than on a public road;

Non-fenced off construction sites within a workplace (such as during building repairs or alterations, or other forms of modification, extension or conversion) which are also covered by Construction Regulations for the duration of works;

Temporary work sites (e.g. travelling fairs occupying a site for a short period, or work sites used only infrequently or for short periods) which are covered by the health and welfare rules (see B 5, Welfare and First Aid) which, for such workplaces, apply 'so far as is reasonably practicable' rather than 'absolutely' as for workplaces generally;

Outdoor agricultural and forestry sites away from the undertaking's main buildings are covered only by some of the health and welfare rules (see B 5.1, Sanitary Conveniences; B 5.2, Washing Facilities; and B 5.3, Drinking Water) which, for such workplaces, apply 'so far as is reasonably practicable' rather than 'absolutely' as for workplaces generally.
