This Apprenticeship Agreement is used when an employer takes on an apprentice and undertakes to train the apprentice in the skills needed to carry out a trade or profession, within a particular ‘Apprenticeship Framework’. Modern apprenticeships consist of on-site training and work experience provided by the employer, and offsite training provided by a ‘Learning Provider’. The apprenticeship relationship is tripartite and our Apprenticeship Agreement makes specific reference to the Learning Provider (although the Learning Provider is not party to the Agreement).
This agreement has been recently updated to include new and improved clauses providing enhanced protection for the employer.
Regulations which came into force in April 2012 prescribed the form which must be used to enter into an apprenticeship agreement; the agreement must be in writing and must also comply with Section 1 of the Employment Rights Act 1996. Further, it must include a statement of the skill, trade or occupation for which the apprentice is being trained.
Our Apprenticeship Agreement contains the standard clauses found in an ordinary employment contract. In addition there are more specific clauses covering the employer/apprentice relationship, and the particular responsibilities of each party. It is essential that you read the Agreement very carefully before employing an apprentice, to ensure that you can comply with the additional responsibilities placed upon an employer of an apprentice.
