Letter – Waiver of Moral Rights by Individual

This Moral Rights Waiver Letter allows an author of a literary work to waive their moral rights (arising under Chapter IV of the Copyright Designs and Patents Act 1988).

This template contains two options. The first asserts the author’s right to be identified (contrary to the letter’s description as a waiver), however it acknowledges that the casual or inadvertent failure of a publisher to identify the author shall not be taken as an infringement of that right and thus effectively waives the author’s right to further enforce the right.

The first option further grants the publisher permission to alter the work as necessary without such alterations constituting distortion, mutilation or derogatory treatment of the work.

The second option is a full waiver (as opposed to a “softening” of the rights) under which the author unconditionally waives all moral rights or, at your selection, certain of those rights (by only waiving those sections of the act relevant to the rights you wish to waive).

Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so as to be compatible with one another. Unused options should be removed from the document.
