Quotation and Extract Licence (Publisher's Version)

Writers will often want to incorporate an extract or quotation from another work into their own. If the quoted work remains in copyright, consent will generally be required. If this is the case, such consent can be formalised in a written agreement.

This Quotation and Extract Licence is designed for use in such situations. Having set out the quotations and / or extracts that are to be used, the agreement sets out important details with respect to the ownership of copyright in the source work, the use to which the licensee can put the quotation/extract, the original author’s right to a credit or acknowledgement and the fee to be paid for the use of the quotation/extract.

Two versions of this document are available. This version is designed for use where a publisher has had the rights in the work either assigned to them or licensed to them by the author and is thus the point of contact for third parties such as the licensee.

Options have been included to allow for the use of this document in either case: the copyright in the original work being assigned to the publisher or licensed to it. Furthermore, where the publisher holds the work under a licence, options allow for that licence to be exclusive or non-exclusive. Removal of these optional phrases assumes that the rights have been assigned to the publisher by the author. Please note that not all options relate to this position, so read them carefully.

An alternative version of this licence, designed for use where the author retains the copyright in the work, is also available.

Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so as to be compatible with one another. Unused options should be removed from the document.
