These Website Terms for Buyers – E-Commerce Marketplace are designed for websites that offer online marketplaces that provide a sales platform for users. Designed to work in a set of three documents along with TR.WEB.TC.15a (Terms of Use) and TR.WEB.TC.16a (Terms for Sellers), these Terms for Buyers set out the rules and procedures governing the use of your online marketplace by users wishing to buy items.

These terms have been written in such a way that they can be applied to sales of both goods and digital content, allowing your users considerable flexibility on your marketplace.

Of central importance is your role in transactions. These Terms for Buyers clearly state that you, the website operator, are not a party to any transactions, nor to any disputes. You merely provide an online venue for buyers and sellers. Further provisions explain to buyers that you are not responsible for any items sold by sellers on your marketplace.

When dealing with payment facilities, this document is drafted on the assumption that a third party payment system will be used and thus explains to users that their use of that system will be subject to a separate agreement between them and the service provider.

Further key clauses set out acceptable usage, making purchases and payments to sellers, delivery and associated time limits, buyers’ rights to cancel (including the 14 day “cooling off” period for consumers and provisions dealing with items that are not of satisfactory quality, fit for purpose, or as described), and your liability.
