This Section 26 Notice – Tenant’s Request for a New Business Tenancy is the prescribed statutory notice a tenant must serve on its landlord if it wishes to be granted a new lease when its current lease expires.

The Section 26 Notice can be served twelve months before the end of the term of the lease or at any time thereafter. The Notice must specify a termination date that is between 6 and 12 months from the date the Notice is served (but the termination date cannot be earlier than the end of the contractual term of the lease). A Section 26 Notice cannot be served if the landlord has already served a Section 25 Notice.

The Notice includes the tenant’s proposals for the grant of a new lease (term, rent etc.) and some pre-printed notes for the landlord explaining the effect of the Section 26 Notice and what steps the landlord now needs to take.
