This Tenant’s Letter Terminating a Periodic Assured Shorthold Tenancy should be sent to a landlord by a tenant who wishes to terminate an Assured Shorthold Tenancy (AST) that has become a periodic AST. 

If the landlord has not served a Section 21 Notice to bring the tenancy to an end, an assured shorthold tenant is allowed to remain in occupation of the property after the end of the fixed term of his tenancy.  The tenancy becomes a “periodic” AST.  The periodic tenancy can be terminated by the landlord or the tenant by giving the appropriate notice – a Section 21 Notice for the landlord or this Tenant’s Termination Letter for the tenant.

The letter must specify the date on which the tenancy is to end. If rent is paid monthly the notice period given to the landlord must be at least 1 month and must expire on the last day of a rent period.  For example, if rent is paid on the 10th of the month, the tenancy must terminate at midnight on the 9th of a month.  If rent is paid weekly the tenant must give 4 weeks’ notice and the tenancy must expire on the last day of the week (e.g. on a Sunday if rent is paid every Monday).

The letter should be delivered by hand or sent by recorded delivery.  Note that the notice period begins from the time the landlord receives the letter, not when the letter was posted.  If you are posting the letter, remember to allow 2 or 3 days for delivery.

The letter asks the landlord to acknowledge receipt of the letter by signing a duplicate and returning it to the tenant.  A stamped addressed envelope can be enclosed.  It is not essential for the landlord to acknowledge receipt of the letter, but it is helpful for the tenant to know that the letter has been received.  The letter also asks the landlord to confirm what the check-out procedures will be and reminds him to return the tenancy deposit (if one was taken).

Optional phrases / clauses are enclosed in square brackets.  These should be read carefully and selected so as to be compatible with one another.  Unused options should be removed from the document.
