This Tenant’s Letter Confirming Intention to Vacate at the End of the Fixed Term can be sent to a landlord by a tenant who does not wish to remain at the property after the fixed term of an Assured Shorthold Tenancy (AST) has expired.

If the landlord has not served a Section 21 Notice, an assured shorthold tenant is allowed to remain in occupation of the property after the end of the fixed term of his tenancy.  The tenancy becomes a “periodic” AST. The periodic tenancy can be terminated by the landlord or the tenant by giving the appropriate notice – a Section 21 Notice for the landlord or the Tenant’s Termination Letter in the case of a tenant.

If the tenant intends to leave the property when the fixed term expires there is no legal requirement to give the landlord notice of this intention.  However, it is courteous to advice the landlord of your plans and helpful to remind the landlord that the tenancy deposit (if there is one) will need to be returned.

The letter asks the landlord to acknowledge receipt of the letter by signing a duplicate and returning it to the tenant.  A stamped addressed envelope can be enclosed.  It is not essential for the landlord to acknowledge receipt of the letter, but it is helpful for the tenant to know that the letter has been received.
