This Section 21(4)(a) Covering Letter for a Periodic Tenancy is a covering letter for a Section 21 Notice. It should be used where the Landlord wishes to terminate an assured shorthold tenancy (AST) that has been periodic from the start. There are very few such tenancies and in most cases Landlords will need to use the Section 21(1)(b) Letter Terminating a Fixed Term Tenancy instead.

An example of a tenancy that is periodic from the start would be a tenancy that has an initial term of one month and is allowed to run on after the initial period.

A completed Section 21 Notice needs to be enclosed with this Letter.

The Letter reminds the Tenant of the steps he must take before vacating the property in order to ensure that the deposit is refunded in full.

The Tenant is asked to sign a copy of the Letter and return it to the Landlord to confirm receipt. The Landlord must remember to send the Tenant two copies of the Letter and a stamped addressed envelope.

The Letter should be delivered by hand or sent by recorded delivery. Remember that the 2 month notice period begins from the time the Tenant receives the Letter, not when the Letter was posted. Always allow a few extra days when setting the termination date. For example, if the Letter is sent by recorded delivery on 25 June, do not give a termination date of 25 August. Instead, select a later date such as 28 August (or such later date as is the end of a period of the tenancy).
