This Retirement Policy (with objectively justified retirement age for all employees) should be used where the employer operates an objectively-justified compulsory retirement age which requires employees to retire at the age set by the employer.

It is no longer possible to retire employees once they reach the age of 65 unless their retirement can be objectively justified as a proportionate means of achieving a legitimate aim. The Department of Business, Information and Skills (BIS) gives air-traffic controllers and police officers as possible examples of where having a retirement age could be justified.

Please note: A compulsory retirement age is likely to be very difficult for employers to objectively justify, and may leave employers open to age discrimination claims if the age set is found by a tribunal to fail the test of being a proportionate means of achieving a legitimate aim.
