Gardener Terms and Conditions (On-going Services)

These Gardener’s Terms and Conditions are designed for use by gardeners providing their services to domestic clients (i.e. consumers). These terms of business can be provided to a client as a stand-alone document or included in a document such as a quotation or displayed on a website. A form of "Service Agreement" is also included that can be used as the “Agreement” referred to in this document. The “Agreement” is the agreement in writing that incorporates these terms of business and constitutes the legally binding contract for the services. Alternatively gardeners can use their own form of agreement.

This particular version of the document is best suited to situations where the gardener is to be providing a regular service (with, for example, fortnightly visits). An alternative version of this document designed for use with one-off transactions is also available.

This document includes a simple cross-reference to a Privacy Policy. A range of Privacy Policy templates is available in our UK GDPR and Data Protection group.

Customers entering into contracts “off the premises” of the trader are given a 14-calendar-day cooling-off period. This means they can change their mind for any reason after placing an order, subject to limited exceptions. Work can however commence within the cooling-off period so long as the customer expressly agrees to this.

The customer is also given a clear and concise summary of the pre-contract information they are entitled to receive.

It is important for all traders to be aware of their obligations and the rights of their customers under consumer protection laws. This document has been drafted with these laws in mind. Take care when amending the template to remain compliant with the legislation and, in particular, make sure you do not include any terms that be deemed “unfair”.

Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so as to be compatible with one another. Unused options should be removed from the document.
