Registering a Lease at the Land Registry

The forms in this subfolder are for tenants to use to register the grant of a new lease at the Land Registry.

As a general rule, a lease or underlease granted for a term of more than 7 years must be registered at the Land Registry. Once registered it will have its own title number, in the same way as a freehold house does. If the lease is not registered, it will not take effect as a “legal” interest but only as an “equitable” interest. This is less secure for the tenant and will make future dealings with the lease more complicated for all concerned.

A lease with a shorter term does not need to be registered in its own right but, if it grants easements (rights over other land, such as a right of way), those easements need to be registered. As above, if the easements are not registered they will not be fully effective.
