Since 2011 it has been illegal to retire an employee simply because they have reached the former default retirement age (DRA) of 65. The DRA was abolished on 6th April 2011.

The only situation in which an employer can now retire a member of staff is if retirement can be objectively justified as a proportionate means of achieving a legitimate aim (e.g. air traffic controllers and police officers).
