Letter Advising a Worker of the Right to Opt out of Sunday Working

This Letter Advising a Worker of the Right to Opt out of Sunday Working has been drafted for retail workers, but this requirement also applies to betting shop workers.

The letter explains that written notice must be given by the employee if he or she wishes to opt out of Sunday working.

Within two months of becoming a shop worker who is, or may be, required to work on Sundays, the employee must be given a written statement explaining his or her right to opt out of Sunday work. This does not apply to shop workers who are only required to work on Sundays. The statement must be sent to new employees and existing employees who have opted into Sunday working. This letter complies with these statutory requirements.

Shop (and betting shop) workers have the right not to be dismissed or subject to detrimental treatment, for example, being refused promotion, for giving, or proposing to give, an opting-out notice to the employer.
