Letter Acknowledging Sunday Working Opt-out Notice from Shop Worker

This Letter Acknowledging Sunday Working Opt-out Notice from Shop Worker has been drafted for retail workers, but this requirement also applies to betting shop workers.

Within two months of becoming a shop worker who is, or may be, required to work on Sundays, the employee must be given a written statement explaining his or her right to opt out of Sunday work. See the Letter Advising a Worker of the Right to Opt out of Sunday Working. The statement must be sent to new employees and existing employees who have opted in to Sunday working.

This letter acknowledges receipt of an employee’s notice to opt out of Sunday working and advises them of the date from which the opt-out will apply. Prior to the end of the three-month period employees can still be required to work all the Sundays provided for in their contracts of employment.

Shop (and betting shop) workers have the right not to be dismissed or subject to detrimental treatment e.g. being refused promotion for giving an opting-out notice to the employer. The letter reminds employees of this right and advises them of the process that must be followed if they change their minds and decide that they no longer object to Sunday working.
