The Dismissal Notice Form is applied in the case of prolonged and persistent sickness absence.

The Dismissal Form is used only after the Company/Employer has sympathetically considered and investigated the prolonged and persistent sickness of the employee, offered positive assistance and consulted with the employee at various stages of the absence and once medical opinion(s) has been sought.

Before applying the Dismissal Notice Form to dismiss an employee for prolonged or persistent absence the Employer/Company should consider all the circumstances of the job, the employee's record and the business position of the Company. Alternative employment should have also been offered (and refused by the employee).

If on seeking medical advice it transpires that the employee is suffering from a disability under the Equality Act 2010, dismissal may then be discriminatory and the employer will be under a duty to make reasonable adjustments.

An employee under notice of termination of employment is entitled to be paid his or her normal rate of pay during the notice period if he or she is incapable of work because of sickness or injury. This is irrespective of whether the employee has been receiving statutory or contractual sick pay prior to notice being given.
