Letter – Breach of Contract Notification (Legal Action)

When a party to a contract breaches that contract the aggrieved party has a number of options ranging from a waiver of the breach to terminating the contract and taking legal action.

This Breach of Contract Notification Letter (Legal Action) represents the third level of severity in the series of breach of contract letters. Under this letter the breaching party is required to rectify their breach(es) and to take any other measures the aggrieved party may wish to include with a view to prevent that party from suffering further losses.

Unlike its softer counterparts, however, this letter does set out the aggrieved party’s intention to claim for damages arising out of the other party’s breach – it merely emphasises that by corrective action the breaching party will be helping itself by avoiding a larger claim.
