Licence to enter Land to carry out works to Neighbouring Land

This Licence to enter Land to carry out works to Neighbouring Land should be used where the owner of land wishes to allow a neighbour to enter the land in order to carry out works to the neighbour’s property, such as external decoration or repairs.

The Licence assumes that the works in question are not major works and that access will only be required for a short period, say less than a week. The Licence provides for a Licence Fee to be paid but this could be expressed as £0 if the Licensor does not wish to make a charge.

Clause 1 contains the definitions. The Licensor can use the “Permitted Days” and “Permitted Hours” definitions to specify the times at which the Licensee may use the land. For example, the Licence Period may be a whole week, but the Licensee may only be allowed access during certain hours on working days.

The definition of Premises makes optional reference to a plan. It is recommended that a plan is included, showing the Premises edged red, so that the extent of the land in question is clear.

Clause 2 contains the grant of the Licence.

Clause 3 contains the Licensee’s covenants. These cover payment of the Licence Fee, use, and the Licensor’s right of entry.  There is an optional clause requiring the Licensee to maintain public liability insurance. Depending on the circumstances, the Licensor may not feel that this is required.

Clause 4 provides for the Licensee to have access to the Premises via the Licensor’s adjoining land, if necessary.

Clause 5 contains some standard clauses including a requirement for notices (e.g. a notice to terminate the Licence) to be served in accordance with section 196 of the Law of Property Act 1925. This means that notices should be delivered by hand or sent by recorded or special delivery post. If the notice is sent by recorded or special delivery post, service is deemed to occur at the time at which the letter would “in the ordinary course” be delivered.
