Asbestos Regulations

Control of Asbestos Regulations 2012

The main thrust of the Asbestos Regulations is to protect all who are liable to be exposed to asbestos, including those in the building and allied trades.

the Regulations require Duty Holders to:

  •  identify any Asbestos Containing Materials (ACMs) in the premises, the amount and condition of ACMs
  • presume that materials contain asbestos unless there is strong evidence that the material does not
  • record and keep up to date the location and condition of the ACMs or presumed ACMs
  • assess the risk from the  ACMs or presumed ACMs
  • prepare a detailed plan on how the risk of the  ACMs or presumed ACMs is to be managed
  • take the requisite steps to implement the management plan
  • periodically review and monitor the management plan and the steps targeted at implementing the plan
  • provide information on the location and condition of the material to anyone likely to work on or disturb the  ACMs or presumed ACMs

If you own, occupy, manage or have responsibilities for non-domestic premises you will have either:

  • a legal duty to manage the risk from this material, or
  • a duty to co-operate with whoever manages these risks

In practical terms this means that any non-domestic building must be surveyed/inspected.
