This Marketing Agency Agreement regulates and records the relationship between a principal and agent. It is relevant where the marketing agent is only required to find customers for the principal. Because the agent does not sell the products the compensation/indemnity clauses seen in the sales agreements do not apply as it falls outside the scope of the EU regulations. It is not relevant for agents who actually makes sales of the principal's product. Sales Agency Agreements are also available.

The agent in this agreement is a sole/exclusive agent. This clause can be altered to suit your purposes.

This template works on the basis that commission will be based on the net invoice price of the products. If this is not appropriate for your business a volume based commission schedule can be adopted from the Principal's sales agency agreement and a net sales value commission schedule can be found in the Agent's sales agreement.

This agreement also allows for the setting of minimum targets for the Agent to reach. The clauses relating to this are bracketed and can be erased if they are not appropriate.
