Section 40 Notice

This Section 40 Notice should be used where a landlord requires information from its tenant about any underleases the tenant has granted. A landlord might require this information to enable it to consider the renewal or termination of the tenant’s lease.

The Notice asks the tenant whether it is occupying the premises and whether there are any undertenants. Further questions must be answered if there are any undertenants.

The Notice includes some pre-printed notes for the tenant explaining the purpose of the Section 40 Notice and the time limit for replying and clarifying what information the tenant needs to provide.

Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so as to be compatible with one another. Unused options should be removed from the document.
