This Letter to Tenant on Expiry of Excluded Lease – Offering Renewal should be used where a lease that is excluded from the security of tenure provisions of the Landlord and Tenant Act 1954 is about to expire.

A tenant under an excluded lease has no right to remain in the premises after the contractual end date of the lease. This is in contrast to the position of a tenant under a standard business lease who has the right to remain in occupation and to request the grant of a new lease.

At the end of the term of an excluded lease, the landlord may be willing to grant a further lease to the tenant. If so, the landlord should send this letter to the tenant. The letter advises the tenant that the lease will shortly come to an end and invites the tenant to discuss terms for the grant of a new lease.

This letter reminds the tenant of its obligations as regards vacating the property at the end of the term, should the lease not be renewed.
