This Letter to Tenant on Expiry of Excluded Lease – No Renewal can be used before the expiry of a business lease that is excluded from the security of tenure provisions of the Landlord and Tenant Act 1954.

When a business lease is excluded from the 1954 Act, the tenant has no right to remain in the premises after the contractual end date of the lease. In contract, tenants who have the protection of the 1954 Act have the right to remain in occupation and can request the grant of a new lease.

At the end of the term of an excluded lease, the landlord may be willing to grant a further lease to the tenant. If so, the landlord should use the alternative version of this letter: see the Lease Expiry Letter – Renewal.

If the landlord is not willing or able to offer a renewal of the lease, it should send this letter to the tenant. This template letter confirms that the tenant must vacate the premises at the end of the term and reminds the tenant of its obligations under the lease regarding how the property must be left.
