Fitness Terms and Conditions (Group Classes: Per Class/Package Bookings)

These Fitness Terms and Conditions (Group Classes: Per Class/Package Bookings) are designed for use where a teacher/instructor runs an exercise class of any type for a group of clients (usually a class of between 4 and 20 people). These terms and conditions are not suitable where a teacher/instructor only works with one client at a time (e.g. as a personal trainer) rather than with a group.  

This template does not specify the nature of the exercises led by the teacher/instructor and so it can be adapted for use for various types of class. 

Where you provide gym facilities or equipment, and not any teaching/instruction, you should instead use the Gym and Health Club Terms and Conditions which you can find in this subfolder.

This document is suitable for use by any fitness class provider whatever the size of the enterprise. Typically the teacher will be a sole trader and he/she will contract personally on these terms with each client who books a class. However, where a company or partnership engages a teacher/instructor to lead the class for it, the company or partnership will contract with the client on these terms.

These terms require each client who participates in a class to be registered with the provider of the class prior to booking. There is no “membership”. The client does not pay any registration or other initial or periodic fee.

The client pays a fee for each class he/she books (booked as a single class or as part of a package of classes). The template requires each class, whether or not it is part of a package of classes, to be booked for a date within a limited time after payment is made.

By paying for a package of classes (typically 4-10 classes) the client receives a discount per class. However, if you only wish to allow payment and booking for single classes and to exclude any option for the client to pay for a package of classes, you should instead use our Fitness (Group Classes: Per Class Booking) Terms and Conditions.

Designed to be as flexible as possible, this template contains a number of optional clauses and/or phrases. Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so that they are compatible with one another. Unused options should be removed from the document.

These terms should be used only where the client booking a class is a “consumer” as defined in the Consumer Rights Act 2015 (i.e. an individual who receives services or uses facilities for his/her personal use and for purposes wholly or mainly outside the purposes of any business of that individual or another). The terms are suitable for use where the contract is an “on premises”, “off premises” or “distance” contract as defined in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The Regulations require you to supply certain information to clients who are consumers before they book any class/es. Where the contract is an “off premises” or “distance” contract, the Regulations also confer on the client certain rights to cancel the class/es booked and we have set these out in the terms themselves.
