These Dance Membership Terms and Conditions (Group or Individual Classes: Per Class/Package Bookings) are designed for use where a teacher/instructor either runs a dance class for a small or large group of clients, or where the teacher/instructor teaches an individual privately. These terms differ from the accompanying Dance Terms and Conditions only in that these terms require clients to become members of the dance school in order to attend any classes. This template does not specify the style or type of dance but it is suitable for use for teaching any style or type of dance (e.g. ballet, tap, jazz, modern, ballroom, line dance, swing, Latin, street, Indian, folk, country, flamenco). It is also suitable for forms of exercise which are essentially forms of dance (e.g. Zumba).

This document is suitable for use by any dance class provider whatever the size of the enterprise but typically the provider will style itself as a “dance school” and it will be a company or partnership. It will engage teachers/instructors to lead classes for it, and the dance school will contract with the client on these terms and conditions. However, these terms and conditions may also be used by a provider who is him/herself the only teacher (operating as a sole trader) in which case he/she will contract personally on these terms with each client who books any class/es.

These terms require each client who participates in a class to be registered with the dance school as a member before booking a class, and to maintain membership in order to book and attend any class. The template provides for clients to pay a membership fee for each quarterly period or other period of membership.

Under these terms, the client also pays a fee for each class he/she books as a single class or as part of a package of classes. This template requires each single or package class to be booked for a date within a limited time after payment is made. Each client can choose whether to pay for a class as a single class or as part of a package. By paying for a package of classes (typically 4-10 classes) the client receives a discount per class, but if you only wish to allow payment and booking for a class individually without an alternative of paying and booking it as part of a package, this template can easily be adapted to exclude that alternative.

Designed to be as flexible as possible, this template contains a number of optional clauses and/or phrases. Optional phrases / clauses are enclosed in square brackets. These should be read carefully and selected so that they are compatible with one another. Unused options should be removed from the document.

These terms should be used only where the client booking a class is a “consumer” as defined in the Consumer Rights Act 2015 (i.e. an individual who receives services or uses facilities for his/her personal use and for purposes wholly or mainly outside the purposes of any business of that individual or another). The terms are suitable for use where the contract is an “on premises”, “off premises” or “distance” contract as defined in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The Regulations require you to supply certain information to clients who are consumers before they book any class/es. Where the contract is an “off premises” or “distance” contract, the Regulations also confer on the client certain rights to cancel the class/es booked and we have set these out in the terms themselves.
