Insolvency Form 6.1 – Statutory Demand (Liquidated Sum)

From 6th April 2017, the Insolvency (England and Wales) Rules 2016 (IR 2016) come into force and this form will no longer be of relevance and should NOT be used. Please refer to the Companies House website for IR 2016 related information and forms.

This Insolvency Form 6.1 can be used to warn a debtor who is an individual or sole trader (not a company) that insolvency proceedings will be commenced if the debt is not paid within 21 days.

Form 6.1 is a statutory demand under section 268(1)(a) of the Insolvency Act 1986. It can be used where a known sum of money exceeding £5,000 (a “liquidated sum”) is owed.

If the debtor does not pay or respond, the next step (in theory) is to present a bankruptcy petition. For more information about Statutory Demands please refer to our Guidance Notes: Debt Recovery and Taking Legal Action.
