Basic / Statutory Minimum Employment Contract
This Basic Employment Contract can be applied to a wide variety of jobs, particularly junior roles.
This contract has been recently updated to include new and improved clauses providing enhanced protection for the employer.
In accordance with the requirements of the Employment Rights Act 1996 (ERA 1996) employers must provide their employees with a written statement of their main terms and conditions of employment and this is often known as a Standard Form Section One Statement.
This Statutory Minimum Employment Contract covers the requirements of a Standard Form Section One Statement. In addition to the minimum terms required by law, Simply-docs has added various extra clauses to benefit the employer such as: confidentiality, salary review, enhanced annual leave provisions and an optional clause providing for a probationary period. This contract must be received by the employee within 8 weeks of commencing employment.
The “Duties” clause allows you to state the duties and responsibilities of the role. Alternatively, you can just state that the duties and responsibilites are ‘as determined by the Company from time to time’ - or simply refer to a separate ‘Job Description’.
The Pensions Act 2014 introduced a new state pension for people reaching state pension age on or after 6 April 2016, replacing the previous basic state pension and additional state pension and ending contracting out for defined-benefit schemes. This employment contract has been updated accordingly with the removal of the clause referring to the contracting out certificate.
The Statutory Minimum Employment Contract is compliant with ERA 1996, the Employment Act 2002 and the Equality Act 2010 and contains the following clauses as per the requirements of Section One of ERA 1996:
