Restrictive Covenant Clauses
These additional Restrictive Covenant Clauses can be added to the Employment Agreements dependent on the employees' seniority, responsibilities and level of contact with customers, suppliers and staff.
Many employers seek to restrict the extent to which an ex-employee can compete with them. Restrictive covenant clauses can be inserted into Employment Agreements to try to prevent them working in a specific geographical area, contacting customers/clients or poaching staff.
As these clauses are a restraint of trade it is important to apply "reasonable" limitations to ensure they can be enforceable as a legitimate means to protect the employers' business interests.
