Apprentice Employment Contract (EMP.APR.01)
Document Description
This Apprentice Employment Contract is based on an Employer taking on an Apprentice. It is now common, but not compulsory, for apprenticeships to involve a learning provider. Any such arrangement will be overlaid by a tripartite agreement usually provided by the provider themselves. However, this Apprentice Employment Contract will provide a binding agreement between the apprentice and the employer, and govern their relationship and duties.

Employers should be aware that apprenticeship employment contracts are fixed term and as such the early termination of one can be somewhat difficult. This apprenticeship contract is for a fixed term until the apprentice reaches the required standard of qualification, after which the employer shall provide the apprentice with a job or else use their reasonable endeavours to find alternative employment. This is therefore a strong commitment on the part of the employer.

There are specific requirements and guidelines to be followed when employing a young worker. For example, they are entitled to more frequent rest breaks as provided for in Clause 5. Employers should therefore be aware of these requirements from the outset and where unsure seek guidance from the National Apprenticeship Service.

Once the apprentice is fully trained and becomes a normal employee, the date of commencement for continuous service will be the start date of the apprenticeship. Once again where there is no available vacancy and apprentice is not kept on at the end of the apprenticeship, the employer should be aware that they are under an obligation to find suitable employment for the apprentice.

The Contract contains most of the ordinary clauses in an Employment Contract with the addition of more specific clauses covering this Employer-Apprentice relationship, and the responsibilities of each party.
