Disciplinary Meeting Letter Following Informal Discussion

This Disciplinary Meeting Letter should be used by employers to start the formal disciplinary procedure by inviting the employee to a formal disciplinary meeting at which the alleged misconduct or poor performance will be discussed.

The letter has an alternative clause which may be used in circumstances where, following an informal discussion with the employee, the employee’s performance or conduct has failed to improve.

Employers should follow the ACAS Code of Practice in relation to disciplinary procedures. According to the ACAS Code of Practice, employers should take formal action only in cases where the misconduct or unsatisfactory performance is serious or where the initial informal action does not bring about an improvement.

The Disciplinary Meeting Letter should be used in conjunction with the Guidance Notes: Disciplinary Procedure and the Disciplinary Policy and Procedure .

It should be noted that the ACAS Code of Practice is not compulsory, however, Employment Tribunals have the power to adjust awards by up to 25% if employers fail to act fairly and reasonably and in accordance with the Code.
