This Car Parking Licence for Single Day should be used where the Owner of a Driveway or a private Parking Space wishes to allow another person to park their car there for a period of 24 hours or less.

This Agreement can be used, for example, by Owners of driveways or parking spaces near railway stations, airports or sports stadiums where there is heavy demand for affordable parking. A different template Car Parking Licence is available for multiple days. We have a Car Park Lease which should be used if the motorist will have exclusive use of the Parking Space.

Clause 1 contains the definitions. A plan can be attached to show the location of the Parking Space if it cannot be adequately described in words.

Clause 2 contains the grant of the Licence. The Licence is personal to the Licensee.

Clause 3 covers payment of the Licence Fee. This can either be paid in full when the Licence is entered into or a deposit can be paid at the outset with the balance becoming payable at a later date.

Clause 4 deals with cancellation. The booking of the Parking Space can be cancelled by the Licensee at any stage but the Licensor will retain a specified amount of money depending on when notice of cancellation is received. This ranges from an administration fee (e.g. £10) for early cancellations to 100% of the Licence Fee for a last minute cancellation. The booking is also deemed to be cancelled if the Licensee has not paid the Licence Fee by the due date.

Clause 5 contains the Licensee’s covenants. These relate to the proper use of the Parking Space.

Clause 6 sets out the Licensee’s rights in the event that the Licensee does not vacate the Parking Space at the end of the Licence Period (an overstay).

Clause 7 contains some standard clauses including a requirement for notices (e.g. a notice to terminate the Licence) to be served in accordance with section 196 of the Law of Property Act 1925. This means that notices should be delivered by hand or sent by recorded or special delivery post. If the notice is sent by recorded or special delivery post, service is deemed to occur at the time at which the letter would “in the ordinary course” be delivered.
