Farm Business Tenant’s Section 1(4) Initial Notice to Landlord

PROP.LAN.20

This Farm Business Tenant’s Section 1(4) Initial Notice to Landlord confirms an agricultural Tenant’s intention to create a farm business tenancy under the Agricultural Tenancies Act 1995.

Section 1(4) Notices must be exchanged before the Landlord and Tenant enter into a farm business tenancy. This is to satisfy the “notice condition” in the 1995 Act. (As an alternative the parties can rely on the “agriculture condition” but using the notice procedure gives the Landlord and Tenant greater certainty.)

There is a separate template Section 1(4) Notice for Landlords: see the Landlord’s FBT Notice.

The Notice satisfies the requirements of Section 1(4) by identifying (by name or a description) the land to be comprised in the tenancy and stating that the Tenant intends the tenancy to be, and remain, a farm business tenancy.

It is good practice to enclose a duplicate Notice for the Landlord to sign and return. This provides the Tenant with evidence that the Notice has been received.
